Welcome to Neon Photography Studio (hereafter “Neon Studio”). These Terms and Conditions (“Terms”) govern your access to and use of our website, https://untitledartist.com/neonstudio (the “Site”), and our photography services (the “Services”). By accessing our Site or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Site or Services.
1. Services
Neon Studio provides a range of photography services, including but not limited to professional headshots, personal portraits, family photos, commercial photography, and documentary photography. Our services are available in digital, film, or a combination of both formats. Specific terms regarding each service, including pricing and deliverables, will be outlined in individual service agreements.
2. Booking and Payments
- Booking: To book our Services, you must provide certain information, including your name, contact details, and service requirements. All bookings are subject to availability and confirmation by Neon Studio.
- Deposits: A non-refundable deposit is required at the time of booking to secure your session date. The deposit amount will be outlined in the package booked or custom service agreement.
- Payment: Full payment for the Services is due on or before the date of the session unless otherwise agreed upon in writing. Accepted payment methods include FPS.
- Cancellations and Rescheduling: Cancellations or rescheduling requests must be made at least 48 hours in advance. Neon Studio reserves the right to retain the deposit for cancellations made with less than 24 hours notice. Rescheduling is subject to availability.
3. Delivery of Products
- Digital Images: High-resolution digital images will be delivered via a secure online gallery or a download link within [Insert Time Frame, e.g., 2 weeks] of the session date.
- Film Photographs: Film photographs, if included in your package, will be processed and delivered within [Insert Time Frame, e.g., 4 weeks].
- Physical Products: Any physical products, such as prints or albums, will be delivered based on the terms agreed upon in the service agreement.
4. Copyright and Usage
- Ownership: Neon Studio retains the copyright to all photographs taken during the session. Clients are granted a non-exclusive, non-transferable license to use the images for personal, non-commercial purposes unless otherwise agreed upon in writing.
- Commercial Use: Commercial use of images is subject to a separate agreement and may incur additional fees.
- Client Usage: Clients are not permitted to alter, edit, or sell the images without express written permission from Neon Studio.
5. Client Responsibilities
- Timeliness: Clients are responsible for arriving on time for their scheduled sessions. Late arrivals may result in reduced session time or rescheduling, at Neon Studio’s discretion.
- Conduct: Clients and their guests are expected to conduct themselves in a respectful and cooperative manner. Neon Studio reserves the right to terminate a session if clients or their guests engage in inappropriate, rude, or disruptive behavior.
- Safety: Clients are responsible for their own safety and the safety of their guests during photography sessions, particularly when shooting in outdoor or public locations. Neon Studio is not liable for any injuries, accidents, theft or damages that occur during such sessions.
6. Limitation of Liability
- General: Neon Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our Site or Services.
- Service Interruptions: While we strive to provide uninterrupted services, Neon Studio shall not be liable for any delays, disruptions, or failures in service due to circumstances beyond our control, including but not limited to natural disasters, equipment failure, or technical issues.
- Image Quality: Neon Studio is not liable for any dissatisfaction with the final images due to factors outside of our control, such as the client’s appearance, choice of location, client’s venue, expressions, or attire.
- Loss or Damage: Neon Studio is not responsible for any loss, damage, or theft of personal items, prototypes, or products brought to the session by the client. Clients are advised to take care of their belongings and ensure they are safely stored during the session.
7. Indemnification
Clients agree to indemnify and hold harmless Neon Studio, its employees, and affiliates from any claims, damages, losses, or expenses arising from their use of the Site or Services, violation of these Terms, or infringement of any intellectual property or other rights of any person or entity.
8. Dispute Resolution
In the event of any dispute arising out of or in connection with these Terms or the Services provided by Neon Studio, the parties agree to attempt to resolve the dispute amicably through good faith negotiations. If the dispute cannot be resolved through negotiation, it shall be submitted to mediation before a mutually agreed-upon mediator.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Hong Kong SAR. Any disputes arising out of or related to these Terms shall be resolved exclusively in the courts located in HKSAR.
10. Changes to These Terms
Neon Studio reserves the right to modify these Terms at any time. Any changes will be posted on this page, and the effective date will be updated. Your continued use of the Site or Services after any changes constitutes your acceptance of the new Terms.
